The administration of justice in the sovereign state of Boyacá, 1857-1886: institutional permanence in the judicial system of Colombia

Abstract

El libro La Administración de Justicia en el Estado Soberano de Boyacá, 1857-1886: permanencias institucionales en el sistema judicial de Colombia, de ediciones Universidad de Boyacá, estudia el desarrollo de la administración de justicia durante la segunda mitad del siglo XIX, con el fin de señalar sus vínculos con las entidades judiciales previstos en la Constitución de 1991. Para el estudio se empleó el método histórico con enfoque cualitativo, a partir de información original y oficial. En lo constitucional, se utilizó el trabajo realizado por Carlos Restrepo Piedrahita Constituciones de la Primera República Liberal 1855-1885. En lo legal, se recurrió a las recopilaciones de leyes de Estado, que en materia penal y procesal penal se expidieron entre 1857 a 1886, que se complementaron con los informes ofrecidos por el Presidente del Estado a la Asamblea Legislativa, de los secretarios al Poder Ejecutivo del Estado, y de los jefes departamentales al Presidente del Estado. Estos fueron publicados en los diarios oficiales El Semanario Oficial y El Boyacense, localizados en los archivos de la Academia Boyacense de Historia, de la Academia Colombiana de Historia y de la Biblioteca Nacional de Colombia. Teniendo en cuenta lo anterior, el libro se estructuró en cuatro capítulos, a saber: el primero, relacionado al estudio de la organización judicial del territorio del Estado de Boyacá, que se dividió entre 1857 a 1879 en circuitos judiciales y luego, de esta última fecha hasta 1886, en departamentos judiciales. El segundo se dedica a la reconstrucción de la estructura orgánica de la administración de justicia, integrada por los jurados, la corte del Estado que, en 1869, cambió su denominación a Tribunal Superior del Estado; los jueces de Estado; los jueces de departamento, los jueces de circuito, al igual que los jueces de distrito. El tercero se ocupa de establecer la jurisdicción y la competencia de los órganos encargados de administrar justicia en Boyacá, con fundamento en las constituciones y leyes allí expedidas. El último capítulo establece las relaciones entre la administración de justicia en el Estado de Boyacá, frente a la actual organización judicial en Colombia. Concluye que dicha estructura, por más de ciento cincuenta años ha venido evolucionando dentro del proceso de codificación, por ser dinámica y cambiante, gracias a la influencia que ha tenido sobre ella la ideología, la política y las guerras civiles. Hasta el punto de presentar similitudes con la actual organización del poder judicial. Se espera que este libro despierte el interés de los académicos, por el estudio de la evolución de la historia de las instituciones judiciales, a manera de contribución a la formación de la memoria histórica, como estrategia que busca mantener la representación científica de la historia de la rama judicial del departamento de Boyacá. 

The book The administration of justice in the sovereign state of Boyacá, 1857-1886: institutional permanence in the judicial system of Colombia, from Ediciones Universidad de Boyacá, studies the development of the administration of justice during the second half of the XIX Century, in order to mark its connections with the justice entities anticipated in 1991 Constitution. For this study, the historical method with a qualitative approach was used, based on original official information. In the constitutional aspect, the work Constitutions of the First Liberal Republic 1855-1885, done by Carlos Restrepo Piedrahita, was used. In the legal aspect, the collections of Laws of the State were turned to, which in terms of criminal and procedural were issued between 1857 and 1886, complementing each other with the reports given by the President of State to the Legislative Assembly, from the secretaries to the Executive State Branch, and from departmental chiefs to the President of the State. These were published in the official newspapers El Semanario Oficial and El Boyacense, located in the archives of the Academia Boyacense de Historia, Academia Colombiana de Historia, and the Librería Nacional de Colombia. Considering the previous information, the book was structured in four chapters: The first one, related to the study of judicial organization of the State’s Boyacá, which was divided between 1857 and 1879 in judicial circuits, and then, from this last date to 1886, in judicial departments. The second chapter, dedicated to the reconstruction of the organic structure of the administration of justice, integrated by the juries; the State Court which, in 1869, changed its name to State Superior Court; the State judges; the department judges; the circuit judges, and the district judges. The third one deals with stablishing the jurisdiction and competence of the entities in charge of administering justice in Boyacá, basing on the constitutions and laws issued there. The last chapter establishes the relations between the administration of justice in the State of Boyacá, compared to the current judicial organization in Colombia. As a conclusion, such structure has been evolving within the codification process for more than one hundred and fifty years, for being dynamic and changing, thanks to the influence which it has had on ideology, politics, and civil wars. To the point of presenting similarities with the current organization of the Judicial Branch. It is expected that this book brings out the interest of the academics, for the study of the evolution of history of judicial institutions, as a contribution to the formation of historical memory, as a strategy which aims for maintaining the scientific representation of the history of the judiciary of the department of Boyacá.
