Los derechos sexuales y reproductivos en las personas privadas de la libertad: caso centros penitenciarios de Ramiriquí y Sogamoso 2017-2019

Abstract

La investigación contiene la identificación de los antecedentes del derecho a la sexualidad y reproductivo en Colombia, la categorización del derecho a la sexualidad y reproductiva conforme a los parámetros jurisprudenciales dentro del contexto de las personas privadas de la libertad en Colombia y la identificación de la efectividad de los derechos sexuales y reproductivos de las personas privadas de la libertad en los establecimientos penitenciarios de Ramiriquí y Sogamoso 2017-2019.

Se analizan los derechos sexuales y reproductivos en las personas privadas de la libertad. Caso centros penitenciarios de Ramiriquí y Sogamoso 2017-2019.

La línea de investigación es el desarrollo humano, jurídico y social sostenible. Esta línea atiende criterios de discusión en un entorno que va girando en la búsqueda de soluciones a la temática jurídica y sociológica que afectan a las personas privadas de la libertad precisando el entorno de Ramiriquí y Sogamoso, donde se denota con qué frecuencia y de qué manera se precisan que tan vulnerado es el derecho sexual y reproductivo. En la presente investigación se hizo necesario el apoyo de otras facultades capaces de construir conceptos interdisciplinares focalizando aspectos de la praxis en los dos establecimientos penitenciarios y carcelarios de las entidades administrativas estatales, así como el fundamento analítico constructivo de la academia o entorno universitario y o profesional, donde se recopilan las políticas públicas de los programas implementados por las entidades estatales que conllevan a la suspensión de derechos de las personas privándoles de su libertad, por ende se trata de satisfacer o demostrar las necesidades del ser humano como fuente prioritaria al desarrollar la investigación. Para el desarrollo del tema propuesto, se utilizó un método cualitativo con análisis en documentos jurisprudenciales basados en las altas ilustraciones y precedentes de la corte constitucional, como quiera que el material recopilado son decisiones, capaces de manejar el cambio social y materializarlo en posturas incluyentes, con el fin de apropiar conceptos y darlos a entender desde precisiones críticas constructivas, por esta razón se hace imprescindible el material ostentado y citado a priori de esta investigación, en tal medida se podrá conceptualizar y lapidar criterios propios con el respaldo argumentativo en el campo del derecho jurídico y con la destreza de darlo a entender a cualquier campo interdisciplinario. Esta investigación está apoyada en tutelas, peticiones, jurisprudencia y estudio de casos que nos permitirán llegar a un razonamiento propio basados en los argumentos presentados por el material jurisprudencial y autores que se citan en este documento. Igualmente, se utilizó el método cualitativo con el fin de recopilar que tan efectivo viene siendo la aplicabilidad de los derechos fundamentales sexuales y reproductivos basado en el recopilado normativo con prioridad a lo promulgado por la Corte Constitucional, acatando las demás disposiciones, entre las más ponderadas se hace referencia al debido proceso y cumplimiento de las leyes nacionales departamentales y municipales fundamentando el análisis constructivo por parte de la academia o entorno universitario y o profesional, donde se recopilan las políticas públicas de los programas implementados por las entidades estatales que conllevan a la suspensión de derechos fundamentales.

De esta manera se hizo importante explorar los conceptos de la Corte Constitucional, de qué manera se están vulnerando los derechos sexuales reproductivos, como se defiende el debido proceso y como se aplica la garantía del Estado en la efectividad de los derechos sexuales y reproductivos respetando los lineamientos legales. The line of research is sustainable human, legal and social development. This line addresses discussion criteria in an environment that is turning in the search for solutions to legal and sociological issues that affect people deprived of their liberty, specifying the Ramiriquí and Sogamoso environment. Where it will be denoted with what frequency and in what way it is specified how violated is the sexual and reproductive right. In the present investigation, the support of other faculties capable of building interdisciplinary concepts is necessary, focusing on aspects of praxis in one in the two penitentiary and prison establishments of the state administrative entities, as well as the constructive analytical foundation of the academy or university environment. professional, where the public policies of the programs implemented by state entities that lead to the suspension of rights of people depriving them of their liberty will be compiled, therefore it is about satisfying or demonstrating the needs of the human being as a priority source when developing the investigation. For the development of the proposed theme, a qualitative method will be used with analysis in jurisprudential documents based on the high illustrations and precedents of the constitutional court, since the material collected are decisions, capable of managing social change and materializing it in inclusive positions, in order to appropriate concepts and make them understand from constructive critical precisions, for this reason the material held and quoted a priori from this research is essential, to such an extent it will be possible to conceptualize and stone own criteria with the argumentative support in the field of legal law and with the ability to convey it to any interdisciplinary field. This investigation is supported by guardianships, petitions, jurisprudence and case studies that will allow us to reach our own reasoning based on the arguments presented by the jurisprudential material and authors cited in this document. For the development of the proposed theme, the qualitative method will be used in order to collect how effective the applicability of fundamental sexual and reproductive rights has been based on the normative compilation with priority to what is promulgated by the constitutional court, abiding by the other provisions among the most weighted we refer to due process and compliance with national, departmental and municipal laws, basing the constructive analysis by the academy, university and professional environment, where the public policies of the programs will be compiled, implemented by the state entities that lead to the suspension of fundamental rights.

In this way, it is important to explore the concepts of the constitutional court in which way sexual reproductive rights are being violated, how due process is defended and how the guarantee of the state is applied in the effectiveness of sexual and reproductive rights, respecting the guidelines legal.
